Business terms

These terms govern the use of Befoo by businesses. They're accepted by whoever registers the business, who declares they can bind it.

1. What Befoo does and what your business does

Befoo provides a tool: digital card, stamping, rewards, notices, promotions (by push notification and by email), posters and statistics.

Your business is solely responsible for its loyalty program and for everything that happens with its customers in relation to its card. In particular:

  • The rules you publish (how a stamp is earned, how many are needed, which reward you give) and honouring them: handing over the reward, its availability and its quality.
  • The stamps your staff give or fail to give, mistakes and disputes on the premises.
  • Rule changes, the expiry you choose and closing the business.
  • The content and accuracy of your promotions (offers, prices, dates) and their compliance with advertising and consumer law.
  • Any customer claim about the program.

Befoo is not a party to the relationship between your business and its customers. Your page and every promotion state that you run the program.

2. Your commitments

  • Honour the advertised reward while the card is active.
  • If you close, honour rewards already earned for 30 days. We'll tell your customers that date.
  • Don't mislead with the rules, and don't change them to the detriment of people who already have stamps (cards in progress keep their conditions until completed).
  • Don't use promotions for spam or for illegal, misleading or offensive content.
  • Follow Google's review policies: no stamps or rewards in exchange for reviews, and no asking only happy customers.
  • Keep a valid contact for your customers.

3. Your customers' data

You see their name, photo (if any) and card activity. You won't see their email, phone or birthday. You may use that data only to run your loyalty program, inside Befoo. You may not export it, share it or use it for other purposes. Messages to your customers are sent through Befoo (by push notification and by email, as each customer chooses, without you ever seeing their address) and only to those who accepted them.

4. Plans, prices and tax

  • The Free plan has no customer limit. It includes one location and doesn't include promotions, offers or automatic messages, which belong to the paid plans.
  • Prices are shown with tax included: you pay exactly the advertised amount. Your invoice breaks down the VAT or IGIC that applies according to your tax details.
  • Each additional location is billed separately, prorated when added or removed.
  • Payment is in advance (monthly or yearly) through Stripe. Invoices are in your dashboard.
  • Upgrading (to a higher plan, or from monthly to yearly) is immediate: a new period starts that day, the new plan is charged in full and the unused part of the previous plan is deducted on the same invoice. If the deduction exceeds the price, the difference stays in your favour for the following invoices.
  • Downgrading (to a lower plan, or from yearly to monthly) takes effect at the end of the paid period: until then you keep your current plan, and the renewal is charged at the new plan's price.
  • You can cancel any time: the service runs until the end of the paid period and then you move to the Free plan: you keep giving stamps, but you lose what is paid (active offers are paused). No refunds for periods already started, except as required by law.
  • Promotions included with a plan don't roll over between months.

5. Your team

You're responsible for who you invite and what your team does with the tool. Remove access for anyone who stops working with you: their sessions close immediately.

6. Suspension

We may suspend a business that breaches these terms (misleading customers, spam, illegal content or fraudulent use). Immediately if serious; otherwise with prior notice.

7. Befoo's liability

We commit to a reasonably available service and to looking after the data. We're not liable for loss of profit or indirect damages, and our total liability is limited to what you paid in the previous 12 months. None of this excludes liability that the law doesn't allow us to exclude.

8. Changes

We may update these terms with reasonable notice. If you disagree, you can close your business before they take effect.

9. Law and jurisdiction

Spanish law. For business-to-business disputes, the courts of Valencia.
